1. About these terms

These Terms of Service ("Terms") govern your access to and use of Footprint, operated by OSXP.AU ("OSXP.AU", "we", "us"). These Terms constitute a legally binding agreement between you and OSXP.AU under the laws of Victoria, Australia.

By creating an account or using Footprint, you confirm that you have the authority to bind the organisation you represent to these Terms.

2. The service

Footprint is an OSINT (Open Source Intelligence) exposure monitoring platform that scans publicly available information to identify security risks associated with your organisation's digital assets.

The service includes:

• Continuous monitoring of nominated domains, assets, and identities
• Breach and credential exposure detection
• Infrastructure and vulnerability scanning
• Threat intelligence enrichment
• Dashboard, alerting, and reporting

3. Authorised use

You may only use Footprint to monitor digital assets that:

• Are owned by your organisation, or
• You have explicit written authorisation to monitor on behalf of the owner

By registering, you warrant that you are authorised to monitor the nominated domains and assets, and that you will not use Footprint for any unlawful purpose.

4. Account responsibilities

• You are responsible for maintaining the security of your account credentials
• You must enable multi-factor authentication for administrator accounts
• You must notify us immediately at security@osxp.au if you suspect unauthorised access
• You are responsible for all activity conducted through your account
• Accounts may not be shared or transferred without our consent

5. Acceptable use

You agree not to:

• Use Footprint to monitor assets you do not own or are not authorised to monitor
• Attempt to circumvent, disable, or interfere with security features of the platform
• Use the platform to conduct offensive security operations against third parties
• Scrape, copy, or redistribute data from Footprint without our written consent
• Introduce malware, viruses, or malicious code into the platform
• Use the platform in any way that violates applicable Australian or international law
• Resell or sub-licence the service without our written consent

6. Subscriptions and payments

Footprint is offered on a subscription basis. Pricing, billing cycles, and plan details are as set out on our pricing page or in your service agreement.

• Subscriptions renew automatically unless cancelled before the renewal date
• All prices are in Australian dollars and exclusive of GST unless stated otherwise
• We reserve the right to update pricing with 30 days' notice
• Refunds are considered on a case-by-case basis at our discretion
• Onboarding fees are non-refundable once onboarding has commenced

7. Intellectual property

OSXP.AU retains all intellectual property rights in the Footprint platform, including software, algorithms, design, and documentation. Nothing in these Terms transfers ownership of our IP to you.

You retain ownership of all data you submit to Footprint. You grant us a limited licence to process that data solely for the purpose of providing the service to you.

8. Confidentiality

Both parties agree to keep confidential any non-public information received from the other party and to use it only for the purposes of this agreement. This obligation survives termination of these Terms for a period of three years.

9. Limitation of liability

To the maximum extent permitted by Australian Consumer Law:

• Footprint is provided "as is" without warranties of any kind beyond those implied by law
• We are not liable for any indirect, incidental, consequential, or punitive damages
• Our total liability to you in any 12-month period is limited to the fees paid by you during that period

Nothing in these Terms limits or excludes any rights you have under the Australian Consumer Law that cannot be excluded by contract, including statutory guarantees for services.

10. Indemnity

You agree to indemnify and hold harmless OSXP.AU from any claims, damages, or costs arising from your use of the platform in breach of these Terms, including any claims arising from your monitoring of assets you were not authorised to monitor.

11. Suspension and termination

We may suspend or terminate your access to Footprint immediately if:

• You breach these Terms
• You fail to pay fees when due
• We are required to do so by law
• Your use poses a security risk to the platform or other customers

You may terminate your subscription at any time by providing 30 days written notice. Upon termination, we will delete your data within 90 days.

12. Governing law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.

We encourage you to contact us at hello@osxp.au before initiating any formal dispute process. Most issues can be resolved quickly and informally.

13. Changes to these terms

We may update these Terms from time to time. We will provide at least 14 days' notice of material changes via email or in-platform notification. Continued use after the effective date constitutes acceptance.
